SEAR 

The Senior Executive Accountability Regime (SEAR) took effect on 1 July 2024. The Central Bank’s Guidance on the IAF contains extensive guidance with regard to the implementation of SEAR. In addition, the Central Bank has also published “Questions from Stakeholders” to provide responses to queries received to-date. 

In-scope firms should refer to the SEAR System “How To” Guide  in relation to submitting relevant documentation via the Central Bank of Ireland (CBI) Portal and the European Central Bank (ECB) Information Management System (IMAS )Portal.

Guidelines on Conduct Standards 

Pursuant to section 53G(1) and section 53H(2) of the Central Bank (Individual Accountability Framework) Act 2023, the Central Bank of Ireland has prepared guidelines on conduct standards and on notification and training for persons subject to conduct standards, which were published within the Guidance on the IAF.

Enhancements to the current Fitness & Probity Regime

On 29 December 2023 new PCF roles were introduced and the F&P Regime was extended to Holding Companies. The Certification Regulations have applied since 8 January 2024.

Fitness and Probity Enforcement Procedures

Following commencement of the IAF Act on the 19 April, on the 20 April 2023, Central Bank updated its procedures in relation to fitness and probity investigations, suspensions and prohibitions to align these with the IAF Act. See our fitness and probity enforcement page for further details.
